Effective Date: August 8, 2025

These Terms and Conditions (“Agreement”) govern your access to and use of the Fast Dots, LLC mobile application (“App”), services, tournaments, and related content (collectively, the “Services”). By downloading, accessing, or using the Services, you (“User”) agree to be bound by this Agreement. If you do not agree, you must not use the Services.

· The User is solely responsible for maintaining the confidentiality and security of their account credentials (username, password, payment information).

· The User is liable for all activity conducted under their account, whether authorized or unauthorized.

· If a minor or third party gains access to the User’s account, the User remains fully responsible for all charges, actions, losses, and damages arising from such use.

· The User acknowledges that the App is an online mobile game that may involve technical flaws, inconsistencies, or vulnerabilities.

· The User expressly understands and accepts that use of the Services involves risks, both known and unknown, including but not limited to data loss, financial loss, unauthorized access, and system errors.

· The User voluntarily assumes all risks of using the App and agrees that Fast Dots, LLC shall not be held liable for any loss or damages.

· The User understands the App, like any online system, may be subject to hacking, malicious attacks, or unauthorized access.

· In the event of unauthorized activity, account compromise, or hacking, the User agrees to indemnify, defend, and hold harmless Fast Dots, LLC from any resulting claims, losses, charges, damages, or liabilities.

· Fast Dots, LLC is not responsible for restoring funds, tokens, or data lost due to unauthorized access, hacking, or User negligence.

· The User acknowledges and accepts that third-party merchant fees, processing fees, and service charges may apply to transactions within the App.

· Such fees shall be the sole responsibility of the User and may be deducted directly from the User’s account.

· The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind.

· Fast Dots, LLC disclaims all express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, reliability, and non-infringement.

· Fast Dots, LLC does not guarantee uninterrupted access, error-free operation, or protection against data loss.

· To the maximum extent permitted by law, Fast Dots, LLC shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to:

·  - User’s use of the App

·  - Loss of data, tokens, or funds

·  - Unauthorized access to accounts

·  - Third-party services or fees

· User’s sole and exclusive remedy is to discontinue use of the Services.

· All content, graphics, logos, software code, and features of the App are the intellectual property of Fast Dots, LLC and may not be copied, modified, distributed, or used without express written permission.

· Users agree not to:

·  - Use cheats, exploits, bots, or unauthorized software in connection with the App.

·  - Attempt to gain unauthorized access to systems, servers, or networks.

·  - Engage in fraud, collusion, or manipulation of tournament results.

·  - Use the App in any way that violates applicable laws.

· Fast Dots, LLC may suspend or terminate any User account, with or without notice, if the User violates this Agreement or engages in fraudulent, harmful, or abusive conduct.

· The User agrees to indemnify, defend, and hold harmless Fast Dots, LLC, its owners, officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising from:

·  - User’s use or misuse of the App

·  - User’s breach of this Agreement

·  - Unauthorized access of User’s account

· This Agreement shall be governed by and construed under the laws of the State of Ohio, without regard to conflict-of-law principles.

· Any disputes shall be resolved exclusively through binding arbitration in [Insert County/State], except for claims brought in small claims court.

· Users waive the right to participate in class actions or collective proceedings.

· Fast Dots, LLC reserves the right to update or modify these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

· If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
